Yes. 9 + the surfer is 10.
Just like jet skis. Can only tow using a 3 place vessel. Seats 3, but driver+ spotter + rider = 3. you must have room on the vessel for the rider(surfer, Et. Al.)

Exactly. I'm also thinking the Texas laws will be revised to be more clear about surfing.
