Thanks for every ones condolences, I'm definitely so so thankful that no one got hurt... If there was anyone behind us, there's a good chance that they would be dead. A boat can be replaced, but it might not get replaced for many months, we're not going to play games with the insurance company. If they feel like playing games they can talk to our lawyers. Hopefully they will cooperate and that won't be necessary.

Just kind of goes to show you that sometimes things are completely out of your control. I will try to keep you guys updated with the situation.
        How about \"Chales\"?

I feel for your situation. Just a month ago, I had just dropped the boat off at storage near the lake, and while driving home I was hit in the rear by a drunk driver. He was traveling over 100 MPH and I was doing less than 40. My wife and I were so thankfull that the boat was not behind us at the time because I know the insurance would be a nightmare. Even as it is, insurance was more than difficult, they did not want to take responsibility at first. he claimed I pulled out in front of him. They refused to pull the police report in a timly manner, etc...

I was a day away from giving the whole thing to my lawyer when the insurance co. took full responsiblity. I still have to fight for total reimbursement for my losses, and even then I won't be made whole again as the law requires. Luckily we were not injured bad, just sore muscles, and stiff necks.

I can not imagine how hard it would be to get proper compensation if the baot was damaged, they would probably just want to repair the hull, and say it is as good as new. No dice!

I say if they just want to fix your boat, the lawyer should be contacted immediatly. At the least the hull MUST be replaced!

Wow, thats aweful....Glad everyone is ok! Hopefully the insurance company cooperates. Even if your insurance cooperates 100%...it will still require alot of patience to jump through all of their hoops.

I would also push as much as possible on replacement if there is significant hull or structural damage. I would use the argument that this just isn't any run-about boat...its a precision molded hull...the sole reason you buy this type of boat.

I'm really sorry to read this, but am glad no one was injured. To maybe shed some light on one question you raised, I was recently reading a thread about a MC that had a tree fall on and collapse the covered storage area. The owner said his ins. co. told him they totalled when damages exceeded 70% of value. It was an older boat though. Again, I'm sorry to hear about your boat.

Good luck bud, and like everyone has mentioned I'm really glad no one was hurt. Although it may take awhile (which will seem like forever) I'm sure the insurance will come through. Sorry again....

Dragon- WOW, You can always get another boat but you can't replace loved ones. Thank God you all didn't get hurt. I don't think I could take it as graciously as you seem to be taking it, just goes to show you that you need to live life to it's fullest everyday cause things just aren't in your control all of the time no matter how careful you are.

Good luck with getting things worked out and replaced and I wish you and your family well. I can't wait to get home and kiss my family.

Well, the battle with the insurance company has begun. It's not going to be pretty. Boat has 25-30K of damage. Our only hope for having a boat this summer is if they total out the boat. Hoping that she'll have stress cracks when they dye the hull. Or that the salvage value makes it worth while for them to total it. The boat hasn't been fully inspected yet, but the insurance adjuster says that it's fixable, I don't think is. If it's not totaled then I will not have a boat until Spring next year. It isn't fair, but then again life is not fair.

I have pictures, but I don't feel comfortable posting them. I don't like looking at them period.
                              How about \"Chales\"?
