Scott, you likely mentioned this and I missed it in all the posts, but did you have an opportunity to report your dog bite to the local animal control?
Unlike the police or the civil legal system, animal control departments, along with the public health services they are often under, have broad powers to take action against animals of any kind that pose a threat to humans. One bite is not going to cause an issue except that the owner will need to prove that the dog is current on its rabies vaccination (your dog is likely vaccinated but you are at risk for rabies and it is critical that you verify that the dog is up to date in regards to its rabies vaccination). But by reporting your bite, if a pattern develops then Animal Control will take action.

yeah, sounds unusual that a civil suit would need to be initiated for a public agency to take action to protect the public -- setting aside the issue of reimbursement for your costs and damages, I mean.
maybe the answer is made at a level above the individual you spoke with . . .2010 Super Air Nautique 210 Team Edition

Went to law school for contractual law. I love dogs, I have two and they are family to my wife and I. Every weekend my terrier plays with a pit bull. This pit was raised in a great environment with a responsible owner. My little terrier bites his ears, growls at him and more and the pit just lays there.
Here is my point of view
1. You don't shoot a dog unless your life is threatened, especially in front of its owners.
2. You need to stick with facts. For example ... The neighborhood has issues with these pits already. .... Pit bulls are commonly known as a violent animal therefore the owner should have trained such animals to be more obedient making the owner responsible.... Labradors normally don't attack animals or people making her story BS especially a puppy.... The owner couldn't restrain these beasts therefore she incidentally allowed the attack causing you physical injury, and your pet physical injury.
Just a few ideas. Been in a few lawsuits and I promise here say doesn't fly with judges. You need to remain very diplomatic.Current Correct Craft Boat

Thank you for that. Im feeling much better about this situation now. The dog is pretty much back to her old self. Stitches and staples come out today so she will be able run all she wants this afternoon. Plus your right, the young girl drastically dramatized the facts, I have a witnesss and neighborhood support. I honestly dont want to see these pits die, but they should certainly be muzzled, properly caged and controlled by an able adult. Dont get me wrong, another few seconds of trying to hold the 1 dog at bay I would have had to shoot it. And I would have been ok with that. But now, weeks later, I dont want to be responsible for killing these girls dogs. Im sure their parents will eventually do that for them through their irresponsibility.
